Beginning August 27, 2024, new telemarketing regulations will be enforced in the UAE, imposing strict limitations and penalties for non-compliance. These regulations are designed to safeguard residents from unwanted and disruptive cold calls, in response to increasing concerns about telemarketing activities.
Main Restrictions and Penalties:
- Permitted Calling Times: Telemarketers are allowed to make calls only between 9 a.m. and 6 p.m. Violations of this rule may lead to fines ranging from Dh10,000 to Dh50,000 for repeat offenders.
- Repeat Calls: If a customer declines a product or service during an initial call, telemarketers are not allowed to call back on the same day. Persistent violations could result in fines up to Dh50,000.
- Unregistered Numbers: Companies using numbers not registered for telemarketing purposes can be fined between Dh25,000 and Dh75,000.
- Do Not Call Registry (DNCR): Contacting customers listed on the DNCR can incur fines up to Dh150,000.
- Call Recording: Companies are required to inform customers if their calls are being recorded, with non-compliance penalties ranging from Dh10,000 to Dh30,000.
- Training and Reporting: Companies that fail to train their telemarketers or submit the necessary reports may face fines up to Dh50,000.
- Failure to Obtain Approval: Companies that do not secure prior approval for telemarketing may face an initial fine of Dh75,000, which can increase to Dh150,000 for subsequent offenses.
- Data Disclosure Failures: Companies may be fined up to Dh75,000 for not revealing the source of consumer data when requested.
Personal Penalties: If a person makes marketing calls using licensed numbers registered under their name, they will incur a fine of Dh5,000 for the first offense. Subsequent violations could lead to fines up to Dh50,000 and potential service restrictions.
These rules, established under Cabinet Resolution No. (57) of 2024, highlight the UAE's dedication to safeguarding consumer rights and promoting responsible telemarketing practices. Companies are urged to adhere strictly to these regulations to avoid significant financial penalties.
