In the UAE, standard working hours are eight per day or 48 per week, as stated in Article 17(1) of the Employment Law. Employers can require up to two additional hours of work per day, according to Article 19(1) of the Employment Law. If you work beyond regular office hours, you are entitled to extra pay, as specified in Article 19(2). Additionally, if you work between 10pm and 4am, you must receive at least a 50% increase in your salary, in line with Article 19(3).
However, if you hold a supervisory or managerial role, you may not be eligible for overtime pay, as per Article 15(4)(b) of Cabinet Resolution No. 1 of 2022. If you are not in such a position, your employer must compensate you for work done outside regular hours. You should notify your employer that you are entitled to overtime pay according to the Employment Law.
If your employer refuses to pay for overtime, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE). To support your claim, provide evidence such as WhatsApp conversations, relevant emails, and documentation of time spent on work after hours. MOHRE may then advise your employer to make the additional payments. If the employer persists in not paying, you can inform MOHRE of your intention to resign. You may resign without notice after 14 days from this notification, in accordance with Article 45(1) of the Employment Law.
