Number of Indians Migrating to Gulf Countries Drops By 21 Per Cent In 2018

Emigration clearances to the Gulf dropped by 21 per cent compared to 2017, standing at 2.95 lakh in the course of the 11-month period which ended on 30 November 2018, reports Times of India.

Compared to the peak of Indian workers’ outflow to the Gulf in 2014 at 7.76 lakh, the decline in 2018 is 62 per cent. These stats are taken from the e-Migrate emigration clearance data, that examines emigration clearance issued to workers holding ECR (emigration check required) passports.

Qatar is the only country in the Gulf region where the number of workers increased in 2018 when compared to 2017. Almost 32,500 workers were granted emigration clearances as compared to close to 25,000 in 2017, a rise of 31 per cent. A Mumbai-based labour recruiter says, “This could be because of increased labour requirement as the country prepares to host the football World Cup 2022.

Washington-based think-tank, Middle East Institute, says there are almost 6-7.50 lakh Indian migrant workers in Qatar, nearly double the number of native Qataris.

The decline, according to the Ministry of External Affairs (MEA), is due to several reasons like Gulf slowdown due to oil prices slumping as well as the Gulf countries filling up posts with their own nationals.

Also, a large number of Indians having ECR passports travel to Gulf countries on tourist visas and convert them to employment visas, thus entirely bypassing the e-Migrate system. These numbers thus are not shown e-migrate clearance data.

ECNR registration in eMigrate system is optional now

India has decided to temporarily halt the mandatory online registration of ECNR passport holders with job visas in 18 countries, including GCC countries.

However, all Indians who want to voluntarily register can do so.

Applicants have to furnish personal, visa and travel details, emergency contact details in India and destination country and contact details of foreign employer/sponsor in the destination country.

On successful completion of registration, the applicant will receive an SMS/email.
They need to re-register only if their work visa has changed when they visit India again.

Indians already working in these countries also can register when they visit their home country.

Only one-time registration is required as long as an Indian remains on the same company’s employment visa. It is not necessary to register every time one goes back home unless there is a change in visa.

Emigration Clearance Required (ECR) passport holders who change their passport status to ECNR after three years of overseas employment will also have to complete the ECNR registration.

People already on employment visa have to register only while they are on a visit to India and before flying back to their country of residence on an employment visa.

The online form could be accessed only from India by using a one-time password which will be sent to an India mobile number fed by the applicant.

Investor visa holders and Dependents of Indian expatriates working in foreign countries need not register on the e-migrate platform. Spouses or children who have jobs, but are on a dependent visa, need not register on the platform.

Since a one-time password (OTP) is required to complete the registration on the platform, expatriates are required to use an Indian mobile number to finish the formality. It is not required that the SIM card is registered under your name. As long as it is an Indian number, it is fine.

Following are the ECR countries:
Afghanistan, Bahrain, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, Sudan, South Sudan, Syria, Thailand, UAE and Yemen.

The recruitment procedure through the eMigrate portal has been in place for ECR category since 2015 to protect them against human trafficking, illegal recruitment and exploitation.

The protection ensured through the eMigrate portal for this category of workers has now been extended to ECNR (emigration clearance not required) passport holders as well.

More than a dozen categories of Indian citizens automatically qualify for ECNR status, including income-tax payers, those below 18 years and above the age of 50, and those with an educational qualification of matriculation and above.

On successful completion of online registration, the applicant would receive a confirmatory SMS/ email. This confirmation will have to be shown at the airport from where the applicant boards the flight.

Indian citizens paying Income tax and those with educational qualifications above matriculation are eligible for ECNR passports.

ECR
Indian citizens without a matriculation certificate need to get an emigration clearance from the office of the Protector of Emigrants of India to travel abroad to 18 countries to seek employment.

As per the Indian Government Emigration Act, 1983, ECR passport holders should get permission from Protector of Emigrants (POE), Ministry of Overseas Indian Affairs for traveling to 18 countries given below.

List of 18 Countries where you need to take a clearance before your travel if your passport is ECR

Afghanistan, Bahrain, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, Sudan, South Sudan, Syria, Thailand, UAE and Yemen.

Nurses Recruitment: Norka-Roots, Overseas Development and Employment Promotion Consultants (ODEPC) and Tamil Nadu Overseas Manpower Corporation are the three government agencies entrusted with the recruitment to 18 ECR countries.

As per the new rule, ECR countries will have to register with the government of India's eMigrate system for getting nurses from India. Once they register electronically and post their requirement of nurses, the Indian missions will vet them and forward to it to the state entities for selection.

After the selection is done and the receipt of the visa; the POE will issue the emigration clearance to the nurses to go to the 18 ECR countries.

How do I check my passport is ECR or ECNR?

You can check the status of your passport very easily. Usually the stamp of the Emigration Check required (ECR) will be on the first two pages of the passport or the last two pages. It is a stamp or print from the passport office which will Say ECR or Emigration Check required.

If this stamp/print appears on your passport you need a clearance from the POE office to travel to the Countries listed above.

Recent Exemption from Government of India for ECR passport holders

With effect from 1st October 2007, Ministry of Overseas Indian Affairs (Emigration Policy Division) have allowed Indian Passport Holder who has ECR, to travel without a Clearance from the POE office for purpose other than Employment. So if you are traveling for Purpose other than Employment you need to produce the following documents:

1. Valid Indian Passport
2. Valid Visa for the Destination Country
3. Valid return Air ticket for travel

Frequently Asked Questions
Q: I don't have ECNR stamp in my Passport. Can I get it on the basis of my provisional matriculation or above certificate issued by the University/Board concerned? 

A: ECNR stamp is no longer affixing  in passports. In fact it is not even printed in the new passport booklets. Currently, only ECR stamp is being put in passports if applicant is not eligible for ECNR. However, you are entitled to ECNR status if you possess qualification of Matriculation or above. Even you can get ECNR status on the basis of provisional matriculation certificate if the mark sheets of all semesters of your course are available with you. Further to get ECNR stamp, the applicant should have stayed abroad for more than 3 years excluding the period(s) of visit to India or should be a dependent who is below 18 years and whose parents have ECNR status in their passports or should be a person (he/she) whose spouse has ECNR status in his or her passport or should be above 50 years of age.

Q: What if my passport is not carrying any stamp regarding ECR or ECNR do I still need to get a Clearance from POE office?

A: Now a days Passport offices are issuing passport without the Emigration Check Required (ECR) or Emigration Check Not Required (ECNR) pages. So if your passport does not have the stamp or the page for ECR that means you are not required to take a POE clearance for your travel. POE clearance is only required if your passport is having a ECR page, Endorsement stamp on it.

Q: What if I have an ECR stamp I want to travel as a tourist?A: According to the new rule you are not required to take permission from the POE office.
In case the passport booklet does not have ECR stamp, the passport holder would be deemed to have been granted ECNR status.

Who are eligible for cancellation of ECR Status?

a. All holders of Diplomatic/official passports.

b. All Gazetted Government Servants.

c. All Income-Tax payers (including Agricultural Income-Tax Payees) in their individual capacity. Proof of assessment of Income-Tax and actual payment of Income Tax for last one year or copy of PAN card to be insisted upon, and not merely payment of advance tax. However, in most cases as an assessment order is not issued separately by the Income Tax department, Income Tax Returns which are stamped by Income Tax authority can be accepted.

d. All professional Degree holders, such as Doctors holding MBBS Degree or equivalent degree in AYURVED, or Homeopathy, accredited journalists, Engineers, Chartered Accountants, Cost Accountants, Lecturers, Teachers, scientists, Advocates, etc.

e. Spouses and dependent children of category of persons listed from (b) to (d).

f. All persons having educational qualification of matriculation and above.

g. Seamen who are in possession of CDC or Sea Cadets, Deck Cadets:

h. who have passed final examination of three year B.Sc. Nautical Sciences Course at T.S. chanakya, Mumbai and

i. who have undergone three months pre-sea training at any of the Government approved Training Institutes such as T.S. CHANAKYA, T.S. REHMAN, T.S. JAWAHAR, MTI(SCI) and NIPM, CHENNAI after production of Identity cards issued by the Shipping Master, MUMBAI/KOLKATA/CHENNAI.

j. Persons holding permanent Immigration Visa, such as the visas of UK, USA and Australia.

k. Persons possessing two years diploma from any Institute recognized by the National Council of Vocational Training (NCVT) or State Council of Vocational Training (SCVT) or persons holding three years' diploma/equivalent degree from institutions like polytechnics recognized by central/state Governments.

l. Nurses possessing qualifications recognized under the Indian Nursing Council Act, 1947.

m. All persons above the age of 50 years. But the holder should change his/her passport after completion of 50 years of age to remove ECR endorsement from the passport.

n. All persons who have been staying abroad for more than three years (the period of three years could be either in one stretch or broken) and their spouses.

o. All children up to the age of 18 years of age. (At the time of re-issue at the age of 18 years, ECR stamping shall be done, if applicable).

e-Migrate Online Registration Procedures Emigration Clearance for Blue-collar Indian Workers and Housemaids

Blue-collar Indian workers whose passports have been endorsed as Emigration Check Required (ECR) will be prohibited from travelling overseas if their prospective job offers are unrecognised by the e-Migrate system.

E-Migrate system, which was launched by the Indian government on June 1, 2015, aims to reduce the number of fraudulent job offers in India, particularly targeted at the country's working class.

Located across ten prominent locations in Delhi, Mumbai, Kolkata, Chennai, Hyderabad, Chandigarh, Kochi, Thiruvananthapuram, Jaipur and Rae Bareilly, representatives from POE offices look to certify whether workers' secured job offers and salaries have been verified by the e-migrate system. If the system fails to identify them, these workers will not be allowed to travel abroad.

Housemaids: Individuals sponsoring housemaid should register in e-Migrate system.

How to register companies and Individuals in eMigrate Website?

Go to https://emigrate.gov.in (System to be accessed through Internet Explorer Version 8 and above only.

Following documents are required. For companies:

Request Letter for registration as Foreign Employer duly signed by the Employer. This letter should be printed on company letterhead. 


Trade License copy

Labour Establishment Card copy (Immigration Card copy for Free Zone companies)

Chamber of Commerce Certificate (for commercial license only). If you don't have Chamber Certificate, you can collect it from Dubai Chamber of Commerce office at Baniyas or DED building near Clock Tower.   

Copy of Memorandum of Association (LLC Agreement / Partnership Agreement)

Passport and Emirates ID copy of Sponsor or Manager

Go to the link Apply for Registration under the Menu Employer


Fill in the details, upload required documents and after submission, you will receive an ARN # starting with PT. You will get Foreign Employer Registration Form. Print it, get company seal, signature of authorized signatory and submit at IVS Global Office along with copies of the uploaded documents.

User ID: Within a week, you will receive Employer Registration Acknowledgement Letter with User ID & Password through your registered Email. Click here for the specimen copy of Acknowledgement Letter.

Next Step: Take Employment Visa, Passport copy of proposed employee, License Copy, eMigrate User ID & Password to IVS Global. Fees: Dh130.

IVS staff will upload necessary documents and you will get  Job ID & Job ID Code through your registered email. You will also get a Consulate Attested Contract from IVS and send this contract to the proposed employee/housemaid.

In India: Employee has to take insurance policy and get stamp from Protector of Immigrants on his/her passport. After that he/she can travel.

What is new?


Indian officials will now be able to verify if the job contracts offered to blue-collar Indian workers back home are the same as the employment contract approved by the UAE Ministry of Human Resources and Emiratisation.

Who will benefit?

Blue-collar Indian workers who require an emigration clearance stamp in their passports and approval from Indian authorities to work in the UAE will benefit. About 45 per cent of the over two million Indians working in the UAE are from this category.

What is the benefit?


Workers will not be cheated with discrepancies in wages and other benefits or duped by fake visas or job offers.

New UAE laws protect workers
In 2018, the UAE introduced sweeping rules that guarantee workers' rights. Ministerial Decrees 764, 765 and 766 paved the way for improved labour relations by securing more stable practices governed by regulations that protect workers who are legally sponsored to enter the UAE. The rules ensure greater transparency, clarity and tighter monitoring of labour contract conditions.

The decrees created a new unified, standard labour contract that stipulates a new unified contract which, in addition to the employment offer, the terms of which cannot be altered or substituted unless approved by the ministry.
No clauses can be added to any contract unless compliant with and approved by the labour ministry.
