Can An Employer in UAE Legally Terminate Employees During Pregnancy?

 The UAE employment law offers significant protections for female employees, particularly regarding termination during pregnancy and maternity leave. According to Article 30(8) of Federal Decree Law No. 33 of 2021 (Employment Law), employers are strictly prohibited from terminating female employees due to pregnancy, maternity leave, or related absences.

Additionally, the law prevents employers from misusing its provisions or taking actions that could pressure employees in violation of their rights, as outlined in Article 65(2). Remote work arrangements are also permitted during emergencies under Article 36(1)(a) of Cabinet Resolution No. 1 of 2022, ensuring employees can fulfill their roles in extraordinary circumstances.

If you’ve been terminated, the Employment Law mandates that dismissals must be based on valid reasons. Under Article 47, dismissals deemed arbitrary may entitle the employee to compensation, with the amount determined by a court, up to a maximum of three months' salary.
