Flying into Dubai? Here's what you need to know

According to the latest update by Emirates Airlines, passengers are required to follow certain processes before flying into Dubai.

Beginning August 1, passengers coming to Dubai, including those taking connecting flights in Dubai, must have a negative Covid-19 test certificate. The test has to be done a maximum of 96 hours before departure. The test excludes children under the age of 12 and passengers who have a moderate or severe disability.

A travel insurance with a Covid-19 cover is mandatory or declare to bear the costs for treatment and isolation if you don't have one before travelling.
Passengers will not be allowed to board a flight without a test certificate. If the UAE has specified a designated laboratory in the country of origin, then the traveller must obtain the certificate from that lab. A printed test certificate is must as a digital version on a phone will not be accepted.

A negative Covid-19 PCR test certificate is a must if you travelling from one of the destinations listed below. This rule also applies to those who have travelled from these points to other destinations and have taken an Emirates flight to Dubai. The mandatory test before travel applies to:
Afghanistan, Armenia, Brazil, Bangladesh, Djibouti, Egypt, Eritrea, India, Indonesia, Iran, Iraq, Kazakhstan, Kyrgyzstan, Lebanon, Montenegro, Nigeria, Pakistan, Philippines, Russian Federation, Serbia, Somalia, South Africa, Sri Lanka, Sudan, Tajikistan, Tanzania, Turkmenistan, Uzbekistan and USA (Dallas Fort Worth, Houston, Los Angeles, San Francisco, Fort Lauderdale and Orlando, including passengers originating from California, Florida and Texas connecting to an Emirates flight from any airport worldwide to Dubai).

A Covid-19 PCR test is also available on arrival in Dubai if you haven't taken one in your home country (excluding travellers arriving from the countries above, who must have a negative test certificate to be accepted on the flight).

If you take a Covid-19 PCR test on arrival, you have to self-isolate until you get your test result. If the test result is negative, you are allowed to leave your hotel and enjoy your trip as normal.  If it's positive, you have to follow the advice of the Dubai Health Authority and remain in self-isolation.

Lost your job amid Covid-19? You must have housing allowance until you leave UAE

The Ministerial Resolution No. 279 of 2020 (Concerning the Employment Stability in Establishments of the Private Sector During the Application of Precautionary Measures to Control the Novel Coronavirus Outbreak) is silent regarding the termination of an employee due to the prevailing Covid-19 situation. However, your employer may be obligated to pay you the housing allowance and other allowances, excluding your basic pay, until you leave the country or until you find a new employment in the UAE.

This is in accordance with Article 3 of the Ministerial Resolution No. 279 of 2020, which states: "Establishments affected by the mentioned precautionary measures, which have an excess of non-national employees authorised to work for them, shall register their data in the virtual labour market system to enable their rotation according to the needs of other establishments, provided that their obligations towards these employees remain the same in terms of housing and fulfilling all their entitlements (except wages) until they leave the state or they are auhorised to work for another establishment."

Further, your employer may not be in a position to deduct any amount from your end-of-service benefits if it has paid you for accommodation and day-to-day expenses until you travel to India. 

However, if you have to pay any other outstanding amount to your employer for any loans or advances it may have lent you, then the employer has the right to deduct it from your end-of-service benefits. This is in accordance with Article 135 of the Employment Law, which states: "The employer may deduct any amounts due to him from the employee's end-of-service remuneration."

Therefore, you may inform your employer that you are entitled to housing allowance and other support until you leave the country or find new employment in the UAE. If your employer does not agree with you, you may seek further advice from the Ministry of Human Resources and Emiratisation and file a complaint against your employer, if necessary. 

All companies affected by the precautionary measures must register the information of their redundant employees on the virtual labour market so that they can be recruited by other companies based on the job market needs.

UAE visa fine waivers: Questions of Indian expats answered

Indian missions in UAE have responded to their citizens' frequently asked questions regarding the recent visa fine waiver scheme announced by UAE.

Q: My resident/employment visa expired before March 1 and my company is not renewing my visa or the sponsor is not responding. What should I do?

A: You should send your details and copy of passport and visa at ca.abudhabi@mea.gov.in 
(for Abu Dhabi cases) and at cons2.dubai@mea.gov.in (for Dubai and Northern Emirates cases). 
We will send these details to UAE authorities who will process for visa fines waiver. Once the visa fine waiver is approved by the UAE authorities, you will be intimated about it and you can leave the country thereafter but before August 17.

Q: My visit/entry permit visa expired before March 1. What should I do?
A: The visa fine waiver is applicable for both visit visa as well as resident visas expired before March 
1. You are advised to send your details, copy of passport and visa at ca.abudhabi@mea.gov.in (for Abu Dhabi cases) and at cons2.dubai@mea.gov.in (for Dubai and Northern Emirates cases). 
We will send these details to the UAE authorities who will process for visa fine waiver. 
Once visa fine waiver is approved by the UAE authorities, you will be intimated about waiver of fines and you can leave the country, but before August 17.

Q: I don't have a passport and want to apply for Emergency Certificate (EC). I entered before March 1 or my visa expired before March 1. What will be the process?

A: In case you are not in possession of a valid passport, it is advisable to apply for EC from embassy/consulate at the earliest. Please ensure that you have a copy of the first information report (FIR) of loss of passport, which is required by the airport immigration.

Q: My resident/visit visa expired before March 1. I have already booked a ticket in the next two-three days to go back to India. Can I get visa fine waiver?

Answer: In order to avail visa fine waiver, you are required to send details to embassy or consulate, which will forward it to the UAE authorities for approval which will take five to six working days. Again, approval of visa fine waiver is prerogative of the UAE authorities. It is entirely your choice. You want to continue your travel plan and pay the fine and go back to India or reschedule your travel and apply for a visa fine waiver.

Q: Will there be an entry ban on cases for visa expired before or after March 1 or in case I travel on EC?

A: As per our understanding, there will not be any re-entry ban to UAE from India on all such cases whose visa fine waiver was approved by the UAE authorities or who leave the country after payment of residence visa violations.

Q: I came on visit visa and my visa expired after March 1. Can I leave the country without payment of fines?

A: There will be no fine if you are able to leave the country before August 10

Q: My resident visa/employment visa /dependent visa etc got expired after March 1. My company is not renewing my visa or sponsor not reachable. What should I do?

A: The waiver was applicable until July 11 for these cases. All resident visa expiry cases should be regularised before October 10. However, resident visa holders are required to complete documentation at the earliest possible.

In case, you are not able to renew your visa after July 10 and leave the country after that, you are liable to pay a penalty of overstaying from July 11 until the date of your actual departure from the country (before August 11) after adjusting expiry of grace period of 30 days.

For example, your resident/employment visa expired on May 25. You intend to travel on August 1 without renewing your existing residence visa. You are liable to pay a penalty for the period June 24 to August 1. (30 days grace period from May 25).

If you leave within the grace period of 30 days after expiry of your existing visa, there will be no fines. However, this will not apply after August 17.

Q: I have been told that I have to leave after I am informed about my visa fine waiver? Will I be able to get flights?

A: There is a lot of Vande Bharat Mission flights and chartered flights operating between the UAE and India. If any person facing problem in getting tickets, they should write back to us at ca.abudhabi@mea.gov.in or cons2.dubai@mea.gov.in to enable us to help you in getting tickets at the earliest, before August 17.
