Returning to the UAE? Know the quarantine rules in Dubai

The 14-day quarantine is mandatory, but you can do it at home also, read more.
Anyone returning to the UAE is required to go through a 14-day quarantine.
These are the steps you need to follow.

When you book your ticket, you will be provided basic guidelines related to the quarantine.
You will also be asked if you fulfill certain requirements, if you opt for home quarantine.

At the airport, you will go through a COVID-19 test and your request for home quarantine verified.

If you do not fulfill the home quarantine requirements, you will have to book a room at a quarantine hotel.

You will also be required to install and register into the COVID-19 DXB smart App and sign an undertaking to abide by the quarantine rules.
Once you go through the verification process, you can head towards completing the immigration process, collect your luggage and proceed to the hotel or your home.

Who qualifies for home quarantine?
For home quarantine, you should have a separate room with a private bathroom. It is also important that you or the people at home do not fall in the high-risk category.
Communication channels should be active and you should be able to follow all the precautions and guidelines.

Precautions during home quarantine

The COVID-19 DXB Smart app, by Dubai Health Authority (DHA), needs to be downloaded for people arriving in Dubai.
Follow instructions on the COVID-19 DXB Smart app.
If there are any changes in your symptoms, contact DHA through the app or call 997 for an ambulance.

It is advised to stay in your room as much as possible and if you do have to leave for an emergency, to follow the necessary precautions.

Precautions include following good respiratory hygiene habits like covering your mouth and nose with a tissue when coughing or sneezing.

Dos and dont's for caregivers.
The caregiver should be in good health and ensure common surfaces are disinfected regularly.
Avoid touching your eyes, nose and mouth with unwashed hands. Handle laundry with care.
When providing the quarantine person with meals, avoid any contact.

How to donate blood in UAE?

Arbitrary termination (UAE Lbaour Law)

In case your employer has not mentioned the reason for your termination, it may be treated as arbitrary termination (which is similar to the UK concept of unfair dismissal) of employment in accordance with Article 122 of the Labour Law which states: 'A worker's service shall be deemed to have been arbitrarily terminated by his employer if the reason for the termination is irrelevant to the worker and, more particularly, if the reason is that the worker has submitted a serious complaint to the competent authorities or has instituted legal proceedings against the employer that has proved to be valid.'

[If the employee is terminated with immediate effect, he or she] will get compensation in lieu of notice [which can be] 30 days or more, depending on the term of unlimited contract based on total salary, including allowances, or up to 90 days total salary with allowances for a limited contract.

In both cases, gratuity or end-of-service [compensation] will be paid and computed per year of service based on basic pay, no allowances.

Economic loss is a justified cause to terminate employees. It becomes arbitrary if there are no losses or if the company immediately hires a replacement for the terminated employee.

What is the liability of a partner at an LLC company in UAE?

A Limited Liability Company (LLC), as defined by Article 71 of UAE Federal Law No 2 of 2015, concerns commercial companies (New CCL) and came into force on July 1, 2015, replacing the existing Federal Law No: 8 of 1984 and its amendments concerning commercial companies. LLC is a company where the number of partners is at least two but shall not exceed 50. A partner shall be liable only to the extent of the share in the capital. A single natural or corporate person may incorporate and hold an LLC. The holder of the capital of the company shall not be liable for the obligations of the company other than to the extent of the capital as set out in its Memorandum of Association.

Therefore, as per the article, the general rule is that a shareholder in an LLC is responsible only to the extent of his share /shares in the capital of the company. The exception to this general rule, as the court has reasoned, is that such a shareholder will be held personally liable, if he has exploited the principle of the independent liability of the company, as a means to conceal fraudulent acts or misappropriation of funds of the company in order to cause harm to his partners or creditors. In such a case, the protection bestowed by law for a shareholder in a limited liability company will not apply. He will be held liable in his personal capacity for such dispositions in a way that such liability will extend to his personal assets.

Is COVID-19 related dismissal legal while the employee is out of UAE?

Article 90 of the UAE Labour Law states that “without prejudice to the instances in which an employer is entitled to dismiss a worker without notice or without the gratuity provided for in this law, an employer shall not dismiss a worker or serve a notice of dismissal on him while the worker is on leave provided for under this section”.

The stipulation in paragraph (j) of Article 120 of the Law on Regulating Work Relationships  and from what is applied in the jurisdiction of this court that the employer may fire the worker without warning in the event of his absence, and that this right requires the absence of the worker without a valid (legitimate) reason for more than 20 non-successive days during one year or more than seven consecutive days, the court has full authority to assess the validity of the employer’s defence, which was expressed in the absence of the worker from work.

Dubai Court has settled that, “The legal concept of force majeure, which if it occurs to the terms binding on both sides of the contract, makes it impossible to implement the obligation in accordance with Article No 1 of Article 273 of the Civil Transactions Law requires for the description of accidents or force majeure to be: exceptional, not familiar, not possible to expect it at the time of contracting nor can it be paid after it occurred and the judge has the jurisdiction to assess this.”

As a conclusion, the termination exists even if it is prohibited as per Article 90, but to decide whether the termination is arbitrary or not, one must refer to the court’s jurisdiction taking into consideration the documents, circumstances of the case, including for example the coronavirus situation, which resulted in the shutting down of airports, consequently affecting the implementation of the employment agreement.
