Renew your UAE visa if you plan to go abroad; Amnesty doubts cleared

UAE residents whose visas expired after March 1, 2020, have been given an automatic extension by the authorities until the end of this year. However, if any of those residents wish to travel abroad, they need to renew their residency permits before they travel.

according to the directives of the UAE Government, all residents with expired permits after March 1, will have their permits extended until December 31, 2020. However, they may face a problem if they leave the UAE and try to come back.

The reason is that when someone goes outside the UAE and wants to return, authorities at the country from where he or she wants to board a flight back to the UAE may not allow the person concerned to board the plane when they see that the residency visa of the traveller has expired.

Holders of permits that expired after March 1, 2020, can travel outside as their permits are automatically renewed in the system. But return may be difficult. 
Residents can renew their residency permits through online platforms or from Amer centres without the need for a medical check and by paying the same government fees.

holders of UAE visit or tourist visas that expire after March will enjoy the extension of their visas until the end of December 2020.
All entry permits that expire after March 1, 2020, will be valid until the end of the year.

Holders of residency visas that expire after March 1, 2020, and who are still outside the country, will have their visas considered as valid until December 31, 2020.

This grace period will last for another three months, until August 1, 2020.
Those who stand to benefit from this can book a ticket and go to the airport without paying fines.

COVID-19, UAE Amnesty; Your Questions Answered

My visa expired before March 1, 2020
If your visa expired before March 1, 2020, and you were unable to leave the country due to the coronavirus restrictions, an amnesty has been announced from May 18 till August 18.

This applies to residence visas, tourist visas as well as visit visas.

The entry permit holders can leave the country without paying any fines, during this amnesty.

What is the amnesty?
The Council of Ministers issued a decree exempting all violators of the ‘Law on Entry and Residence of Foreigners’ from all fines incurred by them, if the violation occurred before March 1, 2020, if they are leaving the country during a three-month period starting from May 18.

The rules include exemption from all fines incurred by the beneficiary, whether those related to their Emirates ID or the expired work permit.

Also, seeking the amnesty will not prevent you from returning the UAE at a later date, provided you meet the necessary conditions for it.

So, if you wish to avail the amnesty …
1. You should be having a visa which expired before March 1.

2. You can only exit the UAE during the three-month period.

3. You would be exempt from paying any fines related to visa overstay, Emirates ID or work permit expiry.
4. You can return to the UAE at a later date, by applying for a new visa.

But I wish to stay in the UAE
The waiver only applies if you are leaving the country. If you wish to stay within the country you will need to pay overstay fines and correct your visa status by applying for a new UAE visa.

My visa expired after March 1, 2020
Any entry permit, whether it is a tourist, visit, on-arrival, employment, mission, residency or GCC visa – if the visa holder is inside the country – has been extended till December 31, 2020.
Residence visa holders outside the country also benefit from this visa extension, and they can return to the UAE, even if they have been outside the UAE for more than 180 days.

My visa got cancelled
Whether your visa got cancelled before or after March 1, 2020, cancelled residence or e-visas are not included in the amnesty programme.

If you were unable to leave the country before the travel restrictions were implemented, you would be required to change your visa status and apply for a new residence, visit or tourist visa.

Failing to do so would lead to the implementation of visa overstay fines.

UAE amnesty procedures for residents/visitors whose visas expired before March 1, 2020

How to waive your visa fines
If you have expired UAE residency before March 1, 2020, then buy one way ticket, take your passport and go to the airport

If you have expired entry permits like visit or tourist visa before March 1, 2020, then get your ticket, prepare your passport and go to Abu Dhabi, Sharjah or RAK airport six hours before the departure.

If you choose to travel through Dubai, then visit checking centers 48 hours before departure.

Dubai checking centers are:
Al Qusais police station, Civil Aviation Security Center and deportation center near terminal 2.

All illegal residents whose visas expired before March 1, 2020 will need a valid passport or travel document and airline ticket in order for their fines to be waived while they exit the country.

people with entry or residency permits that expired before March 1, 2020, will not have to pay fines and only need have passport and airline ticket.
For the violator with an expired residency permit before March 1, they only need to go to the airport with a valid passport and airline ticket to depart without paying fines.

For the holder of expired visit or tourist visas, they need to go hours earlier to the airport to benefit from the waiver.

The person with an expired entry permit needs to go to the airports six hours earlier before the departure time at Abu Dhabi, Sharjah and Ras Al Khaimah airports to process his departure. However, if he or she is willing to depart from Dubai then he needs to go to the checking centre 48 hours before the departing time.

Dubai checking centres are; Al Qusais Police Station, Civil Aviation Security Centre and deportation centre near terminal 2.

The checking devices are installed at all airports but in Dubai violators need to go to those centres 48 hours before departing.

Violators willing to benefit from the visa waiver order can travel from any airport in the UAE.

People under age of 15 and people of determination were exempted from going to checking centres.

The order includes a waiver of fines on expired Emirates ID, work permits, absconding violators from their sponsors and violators of work contracts.
The new order will exempt the visa violator from paying the fines, paying departing fees, paying the fines of worker card and contract and paying the fees of departure permit.

For people who are sponsoring others and staying illegally in the country, they can benefit from the order but need to leave the country with the people he or she is sponsoring.

All fines will be waived if illegal residents leave the country before August 18.

How to end rent contract early in UAE without penalty amid Covid-19

COVID-19: You can terminate your rental contract if you lose your job – Dubai Rental Dispute Centre

Judgement by rent dispute centre terms employment termination as ‘emergency circumstance'

If you have lost your job, it is now possible to terminate your rental contract in Dubai.

A recent judgement by Dubai's Rental Dispute Management Centre (RDC) confirmed that leases can be terminated in two cases.

1. Force majeure (unforeseeable circumstances that prevent someone from fulfilling contract)-or

2. 'Emergency circumstances'

What was the judgement? 
In the case before the rental dispute centre, the claimant was unable to complete the contract due to loss of job.
The RDC ruled that the claimant's case came within 'emergency circumstances'
It became impossible for the claimant to continue the lease, according the centre's judgement.

What does it mean for the tenant?
This is a significant finding as the termination of employment is deemed to meet the criteria of 'exceptional circumstances' events.
Earlier, tenants could not cite job loss as a reason to terminate a rental agreement.

It would be best for the tenant to approach their landlord directly to inform them of the job loss and request for lease termination.

Get your dues cleared, whether it is the water and electricity bill, or any other service charge and request for lease termination. (read more to know how to disconnect DEWA connection)

Your landlord may agree to terminate the lease. If not, you can reach out to the rental dispute centre.

Each case varies and the judgement, too, can depend on various factors.
What can go against the tenant? If you have a good record as a tenant, paying your rent on time, the good record will work in your favour.
But if you have a history of missing rent or other disputes with your landlord, these can go against you.

How to end rent contract early in UAE without penalty amid Covid-19
A landlord or a tenant may not unilaterally terminate the tenancy contract and it may be terminated mutually by the landlord and the tenant during the term of the contract. This is in accordance with Article 7 of the Dubai Tenancy Law, which states: "Where a lease contract is valid, it may not be unilaterally terminated during its term by the landlord or the tenant. It can only be terminated by mutual consent or in accordance with the provisions of this law."

The terms and conditions mentioned in the tenancy contract is applicable to both the landlord and the tenant. This is in accordance with Article 4(1) of the Amended Dubai Tenancy Law, which states: "The contractual relationship between a landlord and tenant will be regulated by a tenancy contract detailing, in a manner allowing no room for uncertainty, a description of the leased real property, the purpose of the tenancy, the term of the tenancy contract, the rent and payment method, and the name of the owner of the real property, if the landlord is not the owner."

Further, Article 19 of the Dubai Tenancy Law mentions that the tenant must pay the rent on due dates. In the event of non-payment of rent by the tenant, the landlord may seek the tenant's eviction in accordance with Article 25(1)(a) of the Amended Dubai Tenancy law.

Based on the aforementioned provisions of law, as a tenant, you should fulfil the obligations mentioned in your tenancy contract and you may have to pay the two months' rent as penalty for early termination of the contract. However, due to the current Covid-19 pandemic, local authorities have urged both landlords and tenants to come to a consensus related to changes in the terms of the existing tenancy contract.

Both the landlord and the tenant may mutually agree to a reduction in rent; early termination of the tenancy contract; rent-free period options; or any other concessions on the grounds of the pandemic.

The Dubai Tenancy Law and the Amended Dubai Tenancy Law are silent in relation to the termination of the contract due to force majeure. In simple words, force majeure means 'unforeseeable circumstances that prevent someone from fulfilling a contract'.

The pandemic may be considered as an unforeseeable circumstance and, therefore, based on this, you may be able to terminate the tenancy contract with your landlord unilaterally. This is in accordance with Article 273 (1) of the Civil Transactions Law which states: "In contracts binding on both parties, if force majeure supervenes which makes the performance of the contract impossible, the corresponding obligation shall cease, and the contract shall be automatically cancelled." 
If the landlord does not agree with your request, you may approach the Rental Dispute Centre (RDC) in Dubai and file a complaint against your landlord for not agreeing on the early termination of your tenancy contract without payment of any penalty.  

The RDC may accept your complaint and may terminate your tenancy contract without payment of penalty to the landlord. This is in accordance with Article 249 of the Civil Transactions Law, which states: "If exceptional circumstances of a public nature which could not have been foreseen occur as a result of which the performance of the contractual obligation, even if not impossible, becomes oppressive for the obligor so as to threaten him with grave loss, it shall be permissible for the judge - in accordance with the circumstances and after weighing up the interests of each party - to reduce the oppressive obligation to a reasonable level if justice so requires, and any agreement to the contrary shall be void."

ഈ ഓർഡറിനെ അടിസ്ഥാനമാക്കി, 2020 മാർച്ച് ഒന്നിന് മുമ്പ് കാലഹരണപ്പെട്ട വിസിറ്റ്/റസിഡൻസ്  വിസ ഉടമകൾക്ക് പിഴയൊന്നും കൂടാതെ രാജ്യത്ത് നിന്ന് പുറത്തുകടക്കാൻ 2020 ഓഗസ്റ്റ് 18 വരെ സമയമുണ്ട്.

മറ്റു ആനുകൂല്യങ്ങൾ:
1. AMER സേവന കേന്ദ്രം വ്യക്തമാക്കുന്നതനുസരിച്ച്, വിസ ഉടമകൾ രാജ്യത്തിനകത്തോ പുറത്തോ ആണെങ്കിലും എല്ലാ പ്രവാസി റസിഡൻസ് വിസകളും 2020 മാർച്ച് 1 ന് ശേഷം കാലാവധി കഴിഞ്ഞതാണെങ്കിൽ 2020 ഡിസംബർ അവസാനം വരെ സാധുതയുള്ളതായി കണക്കാക്കപ്പെടുന്നു.

2. 180 ദിവസത്തിൽ കൂടുതൽ യു.എ.ഇ ക്ക് പുറത്തുള്ള റെസിഡൻസ് വിസക്കാരുടെ വിസ സാധുതയുള്ളതായി തുടരും, കൂടാതെ വിസ ഉടമകൾക്ക് 2020 ഡിസംബർ 31 വരെ യുഎഇയിലേക്ക് പ്രവേശിക്കാൻ അനുവാദമുണ്ട്.

3. 2020 മാർച്ച് 1ന് ശേഷം കാലഹരണപ്പെടുന്ന എല്ലാ എമിറേറ്റ്സ് ഐഡി കാർഡുകളും 2020 ഡിസംബർ അവസാനം വരെ സാധുവാണ്.

എന്നിരുന്നാലും, ഈ നയത്തിൽ ഉൾപ്പെടാത്ത ചിലത്.

COVID-19 visa extension: Till when are visas valid? August 18 or December 31?

Is your UAE visit or residence visa about to expire? Here is how you can find out how long it is valid.

One of the announcements, made on May 13, was pertaining to waiver of visa fines and giving a three-month grace period to some visa holders.

The order is applicable to permits that expired before March 1, 2020.
Not only be visa fines be waived in this situation, the permit holders would have a three-month grace period to exit the country.

Based on this order, people with entry or residence permits that expired before March 1, 2020 would have until August 18, 2020 to exit the country without incurring any fines. 

If your visa expired before March 1, 2020, the announcement would be applicable.

Earlier, on April 1, it was announced that residency visas and entry permits for expatriates, who are in the country, or those stranded abroad, will be valid until December 31, 2020, if their visas expired after March 1, 2020.

1. As per AMER service centre clarification, all expatriate residence visas, whether the visa holders are inside or outside the country, are considered valid until the end of December 2020, if the expiry date falls after March 1, 2020.
2. Residence visa holders outside the country for more than 180 days will remain valid, and the visa holders will be allowed to enter the UAE untill December 31, 2020.

3. All Emirates ID cards expiring after March 1, 2020 are also, valid until the end of December 2020.

However, this policy does not include
holders of cancelled visas inside the UAE, and 
newborn babies inside UAE with overstay fines, until further notice.

Cancelled Visa and newborn babies 
The amnesty does not include cancelled visas as well as visas for newborn babies inside the UAE.
Holders of cancelled visas are requested to either leave the UAE or change their visa status while staying inside the country.
Overstay fines would be applicable in the cases of cancelled visas.
The overstay fine would be calculated as follows:
Dh221 for first day.
Dh25 for each consequent day.
